Hatch Act complaint filed over Ilhan Omar raid

Democracy Defenders Fund on Oct. 13 filed a Hatch Act complaint after Homeland Security Investigations agents executed a pre-dawn search of Rep. Ilhan Omar’s Washington, D.C., home on Oct. 12, the group said.

The complaint alleges the timing of the raid — days before early voting in Minnesota — amounted to a use of official authority to influence an election in violation of the hatch act, and it names DHS Secretary Markwayne Mullin, USCIS Director Joseph Edlow and Attorney General Todd Blanche as respondents.

Democracy Defenders Fund described the search as “outrageous” and urged the U.S. Office of Special Counsel to investigate potential hatch act violations, saying DOJ policy calls for forbearance on overt investigative steps close to an election. The group filed the complaint alongside ethics experts including Norm Eisen and Richard Painter, the group said.

The Hill reported the filing and noted the complaint argues the search occurred four days before general early voting begins in Minnesota; The Hill also cited a Justice Department statement that the action was part of an ongoing federal criminal investigation.

The hatch act bars federal employees from using their official positions to affect elections, and the complaint points to the administration’s long-standing rule of forbearance at DOJ as a reason the timing should be reviewed, Democracy Defenders Fund wrote.

Omar’s office condemned the search as political intimidation, and the complaint asks the Office of Special Counsel to examine whether named senior officials and any other DHS or DOJ employees violated the hatch act by taking investigatory steps so close to the midterm election.
